FSBO in Montana Service Agreement
FSBO in Montana.com, Inc is an online property advertising company. Throughout this agreement we will refer to the company as FSBO in Montana.com.
FSBO in Montana.com is not a realtor, broker, or in any way affiliated with a real estate firm or office. FSBO in Montana.com does not represent the seller or buyer. FSBO in Montana.com does not offer real estate or legal advice.
FSBO in Montana.com offers online advertisement of your property. The property owner is responsible for all aspects regarding the sale of the property, except the advertising services provided under this agreement. Aside from the initial advertising fee, FSBO in Montana.com will not collect commission or compensation from the buyer or the seller as a result of the property sale. FSBO in Montana.com recommends that you hire the services of a professional (i.e. real estate attorney, title company, bank lender, appraiser, inspector etc.) to assist you in the legal aspects of the transaction. The information on this site should not be used as a substitute for legal, business, real estate, or other professional advice.
FSBO in Montana.com offers two options for its services:
1)Customers will pay FSBO in Montana.com $49. In return, the customer will receive: one property advertised on FSBO in Montana.com for 12 months or until the customer requests the property be removed because it is sold or otherwise, five color photos of the property uploaded by the customer, unlimited characters describing the property, and a color flyer with one of your photos and the information you provided about the property created by FSBO in Montana.com and emailed to you.

2)Customers will pay FSBO in Montana.com $245. In return, the customer will receive: all of the inclusions from option one AND one “For Sale” yard sign with personalized rider displaying your phone number and property id number, one directional “For Sale” sign, one directional “Open House” sign, one InFoPaK outdoor flyer box, and The For Sale By Owner Handbook by Piper Nichole.
FSBO in Montana.com is not responsible for the installation and placement of the signs.
The signs, outdoor flyer box, book, and flyers are non-returnable and non-refundable. The cost of these items has been included in the advertising fee. The signs may not be used or placed on any property that is not advertised on the FSBO in Montana.com website.
The property advertisement will be posted to FSBO in Montana.com within 5 working days after the credit card has been processed or the check has cleared. Pictures must be uploaded at the time of purchase in order for them to be included in the initial posting. In addition, within 7 working days after the payment has cleared, the flyer will be emailed to the customer and if purchased, the signs, InFoPaK outdoor flyer box, and/or book will be shipped.
FSBO in Montana.com does not offer refunds.
FSBO in Montana.com cannot guarantee the sale of your property.
FSBO in Montana.com is not liable or responsible for the accuracy or integrity of the property information on this website. FSBO in Montana.com does not guarantee or assure the quality, accuracy, or entirety of the information. The property owner is responsible for the content of their advertisement. If any errors are found, it is the property owner’s responsibility to notify FSBO in Montana.com immediately so the changes can be made. When accepting this contract, the property owner agrees to maintain the information of their advertisement. In addition, the property owner agrees to notify FSBO in Montana.com of a change of status, such as sale pending or sold. The advertisement will expire after 12 months, upon sale, or when cancelled by the property owner, whichever occurs first.
The property advertisement is for one property and is not transferable to other properties. If you choose to withdraw your advertisement during the 12 month term, you may not resume the ad without paying an additional $49 advertising fee.
FSBO in Montana.com will not lend, share, sell, or knowingly disclose information about you unless required by law. However, as an online company, we cannot control solicitations you may receive as result of your advertisement on FSBO in Montana.com. As with any advertisement, the information you provide regarding your property will be available to the public and FSBO in Montana.com cannot control the use of this information.
FSBO in Montana.com reserves the right to revise its website without prior notification to its customers. Any modifications, updates, adjustments, and variations will be made solely by and at the discretion of FSBO in Montana.com. FSBO in Montana.com has exclusive rights to the contents of its website.

You agree to indemnify, defend, and hold harmless FSBO in Montana.com, its members, partners, officers, directors, and employees from and against any losses, damages, liabilities, or expenses arising out of or resulting from any claims regarding the use or abuse of the FSBO in Montana.com website, software, products, or services.
When you accept the terms of this agreement, you agree that all of the information you have provided is accurate to the best of your knowledge, you will maintain and update this information, you are the legal owner of the advertised property, you have not listed your property with a real estate agent or broker, the advertisement is for one property and once expired, cannot be transferred or renewed without repaying the advertising fee, and the FSBO in Montana.com signs will only be used on the property advertised with FSBO in Montana.com. You confirm that you have read and agree to all the terms of this agreement.
FSBO in Montana.com has the right to remove the advertisement at any time if you are not in compliance with this service agreement.
